Italy / Mobbing: from the emergence of the phenomenon to initial reactions
This essay introduces the phenomenon of mobbing with particular reference to legal aspects, such as the prospects for appropriate legislation. The authors set out by defining mobbing and the context in which it takes place. After outlining the main characteristics of the phenomenon – among which the most recurrent consequences for victims and companies – they review the various reactions against mobbing, especially from magistrates. They then provide a brief overview of Italian bills on the subject (they also mention the solution adopted in France recently with the law on moral harassment of January 2002) and the experimental inclusion of norms on the problems of mobbing and, in general, moral violence at the workplace within collective agreements.
