This analysis focuses on the relationship that exists between the system of laws drawn up in a democratic system by bodies representative of the will of the people, and the management thereof, which, in the Italian legal system, is substantially entrusted to the managers of the different levels of government. Without creating a dialectic comparison between the results of management control performed by an external body (the Corte dei conti, or Audit Office), made up of magistrates who, in view of their status, ensure an independent judgment and those of the internal audit system, run by the managers themselves, the quality of normative regulation will be unsatisfactory for some time to come. It is necessary to recreate the conditions for public managers to regain a substantial degree of independence from political power. In this respect, the system of guarantees protecting managers needs to be reconstructed in the light of the principle set out in art. 98 of the Constitution whereby civil servants are at the service of the nation.
